Foot Locker x LIVSHOWS Contest Rules
1. The Foot Locker x LIVSHOWS contest (the “Contest”) is sponsored by Foot Locker Canada Co. (the “Sponsor”). The Contest begins at 10AM PST on Monday July 18th 2022 and ends at 7PM PST on Sunday September 25th, 2022 (the “Contest Period”).
2. The Contest is open to residents of Vancouver, British Columbia who are 18 or older at the time of entry, except for employees of the Sponsor, Livshows, their respective affiliates or of their advertising and promotional agencies and the immediate family of such employees and persons with whom such employees are domiciled. “Immediate family” is defined as parents, siblings, children or spouse.
3. No purchase necessary to enter. In the event of a dispute, all email entries will be deemed to have been submitted by the owner of the email account from which they were sent.
4. To enter, during the Contest Period send the following to FLCEventsVancouver@footlocker.com (i) your full name; (ii) your email address; (iii) your portfolio/Instagram profile; and (iv) a brief as to what inspires you about Vancouver and how sneaker culture has shaped the city. The brief must comply with the format and content requirements detailed in paragraph 5 below by Monday August 1st 2022 at 6PM PST.
Subject to compliance with these Rules, after submitting the required information as above, which must be received during the Contest Period, you will automatically receive one (1) entry into the Contest. Limit of one (1) entry per person.
By entering this Contest, each entrant consents to the Sponsor’s and its agents’ collection, use and disclosure of entry information for the purposes of administering this Contest in accordance with its privacy policy. For more information, please visit our Privacy Policy.
5. The brief portion of each entry submission:
(a) must not exceed 200 words;
(b) must be the original work of the entrant;
(c) must not contain material that is inappropriate, indecent, contain profanity, sexual content, hateful content of any kind, content that promotes violence or harm to another living creature, or any other offensive content (as determined by the Sponsor in its sole discretion);
(d) must not contain material that promotes any activities that may appear unsafe or dangerous;
(e) must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
(f) must not contain advertisements, personal solicitations or commercial solicitations; or promote any political agenda or party;
(g) must not contain materials embodying the names, likenesses, or other identifying elements of any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without express written permission from the person or persons (or their parent/legal guardian for minors) depicted in the submission;
(h) must be submitted only once;
(i) must not have been used for another contest or promotion;
(j) must not contain any copyrighted works (other than as owned by the entrant);
(k) must not violate any law, regulation or third party policies.
6. Between 10AM PST August 2nd, 2022 and 6PM PST August 3rd, 2022, entries will be reviewed by a panel of three (3) judges appointed by the Sponsor. Each eligible entry will be assigned a score (on a scale of 1 – 5, with 5 being the highest) on the basis of the following equally weighted judging criteria: (i) how Vancouver is incorporated into the brief; and (ii) how sneaker culture is incorporated into the brief.
7. On or about August 5th 2022, the individuals whose entries are awarded the top ten (10) highest scores (as determined by the judges in their sole and absolute discretion) (the “semi-finalists”) will be contacted by email and asked to confirm their participation in the next round of the Contest. If a selected semi-finalist cannot be contacted (or fails to respond to any message) within one (1) day of the Sponsor’s first attempt to contact such selected entrant or declines or otherwise fails to confirm participation in the next round, such selected semi-finalist will be disqualified and the entry with the next highest score will be selected and the process above will be repeated until such time as all ten (10) semi-finalists have been confirmed (or there are no more eligible entries, whichever comes first). Odds of being selected as a semi-finalist will depend on the number of entries received and the caliber of the entries in meeting the criteria identified above.
8. Each of the ten (10) semi-finalists will be required to create an immersive art installation within the LIVSHOWS platform (each an “Installation”). The semi-finalists will have a four (4) week period (between August 12st 2022 and September 9th, 2022) to create their Installations. Use of the LIVSHOWS platform will be subject to the terms of use and privacy policy at (https://www.livshows.com/privacypolicy); in order to use the platform semi-finalists must create an account with LIVSHOWS. The semi-finalists will be provided with a video to explain the LIVSHOWS AR platform, as well as guidelines for the Installation.
9. Installations must be submitted by 6PM PST on September 9th 2022. Submissions to be made by email at FLCEventsVancouver@footlocker.com and must include (i) full name and email address (ii) a link to the Installation; (iii) a screenshot of the Installation; and (iiii) a description of the Installation.
10. Between 10AM PST September 12th, 2022 and 6PM PST September 13th, 2022, the semi-finalist Installations will be reviewed by a panel of three (3) judges appointed by the Sponsor. Each Installation will be assigned a score (on a scale of 1 – 5, with 5 being the highest) on the basis of the following equally weighted judging criteria: (i) how Vancouver is incorporated into the Installation; (ii) how sneaker culture is incorporated into the Installation; and (iii) how the semi-finalist has utilized the LIVSHOWS AR platform capabilities.
11. On or about September 16th 2022, the semi-finalists whose Installations are awarded the top three (3) highest scores (as determined by the judges in their sole and absolute discretion) (the “finalists”) will be contacted by email. Odds of being selected as a finalist will depend on the caliber of the entries in meeting the criteria identified above, and will be no less than 3 in 10.
12. Each of the three (3) finalists and their Installations will be showcased between 12PM PST September 19th, 2022 and 6PM PST on September 25th, 2022 (i) at the Foot Locker store at 1067 Robson St, Vancouver, BC, V6E 1A9 CA and (ii) Foot Locker Vancouver Instagram Account @footlockervancouver. On September 25th, 2022 between 10AM PST and 6PM PST (the “Voting Period”), members of the public can vote on their favourite Installation through the Sponsor’s Instagram Stories. The in-store showcasing’s will include QR codes and information on each finalist. Prizes (as described below) will be awarded based on the number of eligible votes received (as determined by the Sponsor in its sole and absolute discretion). The vote results will be announced on the Sponsor’s Instagram Stories on 7PM PST September 25th, 2022.
In the event of a tie at the end of the Voting Period, the winners of the prizes will be determined based on the Installation that was awarded the highest judged score as set out in paragraph 10 above. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of compliance with the Sponsor’s interpretation of the letter and spirit of these Rules from any individual to vote in the Contest. Failure to provide such proof within the timeline specified by the Sponsor may result in disqualification of the applicable votes that cannot be verified to the complete satisfaction of the Sponsor, in its sole and absolute discretion.
IMPORTANT NOTE: Finalists may encourage other individuals to vote on an Installation; however, no form of incentive, inducement, prize or chance of receiving any incentive, inducement, or prize may be offered as part of such encouragement in furtherance of receiving such individual’s votes for any Installation, nor may any finalist or other individual directly or indirectly associate an Installation with any paid advertising. For example, but without limitation, any attempt by a finalist to increase the number of votes on an Installation by launching an advertising campaign shall be considered by the Sponsor to be a violation of these Rules. Any finalist determined by the Sponsor to be directly or indirectly engaging in such behaviour is subject to disqualification, and the corresponding votes, Installation and finalist are subject to disqualification in the sole and absolute discretion of the Sponsor.
13. The following prizes are available to be won:
(a) First prize: $500 Foot Locker gift card
(b) Second prize: $300 Foot Locker gift card
(c) Third prize: $100 Foot Locker gift card
Any costs or expenses incurred by the winners in claiming or using their prize will be the responsibility of the winners. Sponsor reserves the right to substitute (in whole or in part) a prize of equal or greater value.
14. To be declared a winner and claim a prize, the finalists must:
(a) Be reached by email within three (3) days of the announcement of the vote results.
(b) Be eligible according to these Rules and sign a Declaration and Release form (that will be sent by email) and return it, duly completed to the Sponsor within [five (5)] days of its receipt. The Declaration and Release requires a potential winner to confirm: acceptance of the prize as awarded, agreement to be bound by these Rules, eligibility to participate in the Contest and compliance with these Rules and to release Sponsor, LIVSHOWS, their respective affiliates and advertising and promotional agencies, and suppliers of prizes, materials or services related to the Contest, and the contest judges, and all of their respective employees, directors, officers, shareholders, agents, successors and assigns (collectively, the “Released Parties”) from any liability and damages which could arise out of or are in any way related to the Contest and from the awarding, receipt, possession and/or use or misuse of a prize.
15. By entering the Contest, entrants consent to the use of their names and Installations for publicity purposes without compensation, worldwide in perpetuity and in any form of media including the Internet. Without limitation, finalists acknowledge and agree that the QR codes showcasing their Installations and artwork will remain in-store for approximately two (2) months following the determination of the prize winners.
16. By entering the Contest, entrants: (i) consent to the use of their names and Installations for publicity purposes without further notice or compensation, worldwide in perpetuity and in any form of media, including the Internet, by the Released Parties (ii) waive any and all moral rights that they may have in and to their respective entries with respect to the uses contemplated herein; (iii) agree to release and hold harmless Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action that relates in any way to Sponsor’s use of the entry; (iv) agree to indemnify, release and hold harmless the Released Parties from any liability, death, damages, losses or injury resulting in whole or in part, directly or indirectly, from the entrant’s participation in the Contest or the acceptance, use or misuse of any prize that may be won.
17. Sponsor is not responsible for, (i) late, lost, delayed, not received, damaged, misdirected, incomplete, stolen, postage due or illegible entries; or (ii) failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient. The Released Parties disclaim any liability for damage to any computer system or mobile device resulting from access to or the download of information or materials connected with the Contest. Sponsor reserves the right to cancel or modify the contest if, in its sole discretion, it determines that the contest is not capable of running as originally planned for any reason (such as tampering or infection by computer virus, fraud, technical failures, printing or distribution errors, or any other causes or occurrences have compromised the fairness or integrity of the contest). If, as a result of an error relating to the entry process, drawing or any other aspect of the contest, there are more potential winners of prizes than contemplated in the contest rules, there will be a random draw amongst all eligible prize claimants after the contest closing date to award the prize.
18. By entering the Contest, entrants accept and agree to be bound by these Rules and the decisions of the Sponsor and the judging panels, which are final, binding and conclusive on all matters relative to the Contest.
19. The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. The entrant provides personal information to the Sponsor, not to Instagram. Instagram is completely released of all liability by each entrant in the Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Instagram.
